These Terms of Service ("Terms") govern your access to and use of MoneyMender's website, mobile application, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account or using MoneyMender, you confirm that:

• You have the legal capacity to enter into these Terms
• You will provide accurate and complete information
• You will comply with all applicable laws and regulations

2. Service Description

MoneyMender provides personal financial management tools, including:

• Spending insights and transaction categorization
• Budget creation and tracking
• Savings goals management
• AI-powered financial coaching and recommendations
• Net worth calculation
• Debt payoff planning

MoneyMender is not a financial advisor, bank, or investment service. We provide tools and insights to help you manage your personal finances, but we do not provide professional financial, legal, or tax advice.

3. Account Registration and Security

To use MoneyMender, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription and Billing

MoneyMender offers subscription plans:

• Monthly Plan: $9.99 per month, billed monthly
• Annual Plan: $79 per year, billed annually

By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless canceled before the renewal date. You may cancel at any time through your account settings.

Refund Policy: We do not offer refunds for partial subscription periods. If you cancel, you will retain access until the end of your current billing period.

5. Data Collection and Privacy

We collect and use your financial data to provide our Service. By using MoneyMender:

• You consent to our collection and use of your data as described in our Privacy Policy
• You authorize us to connect to your financial accounts through Plaid
• You understand that we use bank-level encryption to protect your data
• You acknowledge that we never sell your personal information

6. User Responsibilities and Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Share your account credentials with others
• Use automated systems to access the Service without permission
• Reverse engineer or attempt to extract source code
• Violate any applicable laws or regulations

7. Intellectual Property

All content, features, and functionality of MoneyMender, including but not limited to text, graphics, logos, software, and design, are owned by MoneyMender LLC and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. Disclaimers and Limitations of Liability

No Financial Advice: MoneyMender provides tools and insights but does not provide professional financial, investment, legal, or tax advice. You should consult with qualified professionals for specific advice.

Service "As Is": The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability: To the maximum extent permitted by law, MoneyMender shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9. Third-Party Services

MoneyMender uses Plaid to connect to your financial accounts. By using our Service, you also agree to Plaid's terms and privacy policy. We are not responsible for the practices or content of third-party services.

10. Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activity.

Upon termination, your right to use the Service will immediately cease. We may retain certain data as required by law or for legitimate business purposes.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of MoneyMender after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
